Stucco Class Action
This case began as a single homeowner lawsuit that was filed against Del Webb and its successor, Pulte, for stucco installation deficiencies
that resulted in water intrusion damages. As the single homeowner claim progressed, a number of other homeowners in Sun City had very similar
complaints as those of the original claimant. Robert G. Sisnroy, a licensed Professional Engineer, has performed a visual evaluation of
approximately 200 homes regarding stucco installation deficiency conditions. Mr. Sisnroy is of the opinion that none of the stucco cladding
that he observed was installed properly. He has performed destructive testing including intrusive observations to a number of homes in order
to verify his visual findings.
A Class Action Complaint was filed against Del Webb and Pulte on July 6, 2006. Shortly after the filing of the Class Action lawsuit, the parties
agreed to submit the case including the determination of all class allegations to binding arbitration. The arbitration process is typically
more expeditious in obtaining a final determination of claims than the typical timeframe it takes a case to move through the Circuit Court
judicial process. The parties have also entered into a Consent Scheduling Order wherein a Motion to certify the class must be made by April 30, 2007.
Counsel is in the process of filing this Motion with the arbitrator. There are more than 500 homeowners that have sought to participate in
this case prior to the motion for certification being filed.
